La Primera Sala de la Suprema Corte de Justicia de la Nación (SCJN) declaró inconstitucional la Ley General de Comunicación Social impulsada por el gobierno del ex presidente Enrique Peña Nieto, también conocida como “Ley Chayote”.

Los ministros de la SCJN indicaron que esta ley otorga al Gobierno “enorme discrecionalidad” para ejercer su gasto en difusión.

Añadieron que la legislación atenta contra la libertad de expresión porque no contiene criterios claros y objetivos sobre el ejercicio del gasto público en materia de comunicación social y contratación de medios.

El caso derivó de un amparo presentado por la organización Artículo 19, a la que se le concedió la protección constitucional.
